For new projects installed under subsidy schemes: The installer of the plant has the obligation of operation & maintenance for 5 years in the case for CAPEX projects & 25 years for RESCO projects.
For non-subsidized projects & projects in which the term of operation & maintenance has expired: The owner of the plant can engage a contractor for operation & maintenance of their plant by signing a separate O&M contract (if not mentioned in the Engineering, Procurement & Installation Agreement or if the term of the O&M agreement has expired). The term of this agreement can be mutually agreed between the parties i.e. the owner of the plant & the contractor.
